Terms and conditions

  1. 1.1. These Terms and Conditions ("Terms") govern the use of the Fosite.co.uk platform ("Service") operated by Fosite Technologies Ltd. ("Provider").
  2. 1.2. By using the Service, the user ("User") agrees to be legally bound by these Terms. If the User does not accept these Terms, they must not use the Service.
  3. 1.3. These Terms apply to all services provided by Fosite, including encrypted file transfers, legal certification, user account creation, customer service, and all related digital functions.
  4. 1.4. The Service is available only to persons over 18 years of age with full legal capacity and to legal entities.
  1. 2.1. Fosite.co.uk is a digital, encrypted file-transfer platform that treats transmitted content as legally protected intellectual property.
  2. 2.2. Each file transfer automatically includes:
    • Encryption: AES-256 or higher.
    • Timestamping: Certified under eIDAS Regulation (EU) No 910/2014.
    • Metadata Protection: Includes IP address, timestamp, digital hash, and signature.
    • NDA: Automatic bilateral Non-Disclosure Agreement, enforceable under UK Contract Law and EU Contract Principles.
    • Intellectual Property Protection: All files are protected under the UK Copyright, Designs and Patents Act 1988 and the EU Copyright Directive (Directive 2001/29/EC).
  3. 2.3. This service does not replace national or international patent registration, but provides a timestamped digital certificate admissible as evidence under the guidelines of WIPO (World Intellectual Property Organization).
  1. 3.1. Registration is required to access the Service. The User must provide accurate personal and/or business information.
  2. 3.2. The User agrees to:
    • Comply with these Terms;
    • Not transmit illegal or prohibited content;
    • Not attempt unauthorized access to others' files;
    • Protect their own 2FA credentials (optional).
  3. 3.3. The Provider may suspend or delete accounts that violate these Terms or are used for unlawful activity.
  4. 3.4. Under the EU Consumer Rights Directive (2011/83/EU), the User has the right to withdraw within 14 days if the service has not yet been used.
  1. 4.1. The Service price is the actually fees which package you choose.
  2. 4.2. Payments are made via credit card or verified online payment providers.
  3. 4.3. Prices include system operation, encryption infrastructure, and timestamping services.
  4. 4.4. Electronic invoices are issued in accordance with the UK VAT Act 1994 and the Council Directive 2006/112/EC.
  1. 5.1. Uploading a file confirms that the User:
    • Acknowledges the file is subject to copyright law;
    • Accepts mutual obligations with the recipient;
    • Receives a verifiable digital certificate with timestamp, content hash, sender and recipient ID.
  2. 5.2. The certificate is legally admissible:
    • Under UK Civil Procedure Rules (Part 32);
    • As an electronic document under EU eIDAS Regulation;
    • In compliance with WIPO Proof best practices.
  1. 6.1. The Service is provided “as is”. The Provider is not liable for:
    • Unlawful or inaccurate content of files;
    • Third-party misuse;
    • Downtime or data loss during system maintenance.
  2. 6.2. Disputes are first attempted to be resolved amicably. Failing that, the London Commercial Court shall have jurisdiction.
  1. 7.1. These Terms are governed by the laws of the United Kingdom, including:
    • UK Copyright, Designs and Patents Act 1988
    • Data Protection Act 2018 (UK GDPR)
    • UK Electronic Communications Act 2000
    • UK Contract Law (Common Law)
  2. 7.2. The Service also complies with:
    • EU eIDAS Regulation (910/2014)
    • EU GDPR (2016/679)
    • EU Copyright Directive (2001/29/EC)
